COMPETITION TERMS & CONDITIONS
Please read these Competition terms and conditions (“Terms and Conditions”) carefully. Participation in this Competition constitutes your agreement to comply with these Terms and Conditions. If you do not agree with these Terms and Conditions, please do not participate in this Competition.
These Terms and Conditions will govern the MINI X RAGE 2019 Competition.
All participants during the term of this Campaign agree to be bound by the following Terms and Conditions:
1. MINI X RAGE Competition:
MINI X RAGE (“Competition”). The promoter of the Competition is G&G Events and Functions (Pty) Ltd, Registration number: 2016/049124/07
2. Competition Period:
2.1. The Competition will run from 01 May 2019 (10h00) to 08 December 2019 (10h00) (“the Competition Period”).
2.2. The duration of the Competition may be extended or curtailed at the discretion of the Organiser.
3. Who may enter:
3.1. All participants must:
3.1.1. be citizens of the Republic of South Africa and/or a legal resident of the aforesaid country,
3.1.2. be currently residing in the Republic of South Africa at the date of the commencement of the Competition Period,
3.1.3. be a natural person and be between the ages of 17 (seventeen) and 20 (twenty) years old at the date of the commencement of the Competition Period,
3.1.4. have a valid South African Learner’s or Driver’s License at the date of the commencement of the Competition Period,
3.1.5. be between the age of 18 (eighteen) and 20 (twenty) and have a valid South African driver’s license as at 15 January 2020 to qualify for the ultimate prize.
3.2. Participation in this Competition excludes the Organiser, their directors, members, partners, employees, agencies, consultants, any other person who directly or indirectly controls or is controlled by them or any supplier of goods and services in connection with the competition and their spouses, life partners, parents, children, siblings, business partners or associates.
4. How to qualify for the Competition:
4.1. The participant must be attending Rage Festival 2019.
4.2. Participants enter by test driving a MINI during the Competition Period and completing the questionnaire.
4.3. The winner will be chosen on the following criteria:
4.3.1. Test Drive was duration of no less than 15 minutes,
4.3.2. Has a valid South African Driver’s License as at 15 January 2020,
4.3.3. Completes the test drive questionnaire.
5. Should a participant
5.1. Post any material to social media containing nudity, illegal substances or offensive content while associating to the Promoter, Rage Festival or the Sponsor, BMW Group South Africa. The Promoter reserves the right to disqualify that post from the competition.
6. Can I qualify more than once for the Competition:
6.1. The Competition is limited to one ultimate winner and entrants can only enter once. Should there be any dispute in this regard, the Organiser shall be sole adjudicator of the dispute and the Organiser’s decision shall be final.
7. Offer: Ultimate Prize
7.1. There is an ultimate prize: a MINI for 6 months starting in January 2020 (limited to one winner). This prize is not transferable for another prize or for cash and may not be transferred to another person.
8. Terms of Delivery: Ultimate Prize
8.1. G&G will contact the Top 10 test drive participants; via Instagram or Facebook,
8.2. The ultimate winner will be announced at Rage Festival 2019 via Rage Festival’s Instagram & Facebook profiles,
8.3. Should the Organiser not be able to get a hold of a winner after 3 attempts, the prize will be forfeited, and another winner will be chosen.
9. Ultimate Prize Winners Selection
9.1. The winner of the MINI for 6 months in 2020 will be chosen randomly. There will be two phases of draws. The first phase will have all entrees in a draw and 10 names will be drawn at random. These 10 names will be the finalists. The final phase will be a random draw from the 10 finalists live at the Sound Factory. The winner will be chosen as the MINI X RAGE 2019 Winner.
10. Limitation of Liability:
10.1. To the extent permitted by Consumer Protection Act and any other applicable law:
10.1.1. The participant and/or winner hereby indemnifies the Organiser against any direct, indirect, special, incidental, consequential or punitive damages or loss of any kind regardless of how this was caused, and whether it arose under the law of contract or delict or otherwise, because of the participants entrance to the Campaign.
10.1.2. The Organiser excludes all warranties (express or implied), representations and liabilities regarding this Campaign (other than for death or personal injury caused by its negligence and/or fraud).
11.1. In accordance with the confidentiality policies and practices of the Organiser, none of the entry details of any participant in this Campaign will be disclosed or used by the Organiser for any purposes other than for entry into the Campaign.
11.2. Participants acknowledge and accept that the Organiser shall utilise a third party (the “Organiser’s authorized agent(s)”) to contact the participant to arrange delivery of the vehicle. In order to affect the contacting and delivery process, the Organisers shall provide the participant’s information to such third party.
11.3. Details of participants will not be used by the Organiser for related communication should the participants opt-out to receive further communication from the Organiser.
11.4. Information regarding the Campaign that is published on authorized advertising material will also form part of the Terms and Conditions of the Campaign.
11.5. The Organiser may in its sole discretion amend these Terms and Conditions at any time, without notice, and such amendments shall be deemed to have taken effect from the date of publication of the revised Terms and Conditions on the Organiser’s website.
11.6. The onus rests on the participant to constantly check the website for updates to the Terms and Conditions.
11.7. Any person participating in this Campaign does so at his or her own risk and understands the risks and dangers involved with either driving or being a passenger during this Campaign.
11.8. If a person is under the age of 18, he or she hereby confirms that his or her parent or legal guardian is aware of and has consent to any involvement in this Campaign.
11.9. The proprietors and organisers of this Campaign and any entity or person acting on their behalf, or with their license (including any employee or agent or associate of such propriety, organiser or other entity or person) shall not be liable for any loss, damage, injury or death whatsoever suffered by any person while participating in this Campaign, howsoever caused, and incising loss, damage, injury or death arising out of negligence on the part of any person.
11.10. Any adult who brings or permits a minor to participate in this Campaign shall be deemed to indemnify the proprietors or any employee or agent of such proprietors or any person acting on their behalf, against any such loss, damage, injury or death suffered by such minor while participating in this Campaign.
11.11. The Organiser reserves the right, at any time, to verify the validity of participants (including a participant’s identity, age and place of residence) and to reject any participant who has not agreed to these Terms and Conditions. Errors and omissions may be accepted at the Organiser’s discretion. Failure by the Organiser to enforce any of its rights at any stage does not constitute a waiver of those rights.
11.12. If this Campaign is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Organiser, including but not limited to technical difficulties, unauthorized intervention or fraud, the Organiser reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the Campaign as appropriate, subject to the approval of relevant regulatory authorities.
11.13. Same as permitted by Law, the Organiser reserves the right to cancel, suspend or terminate this Campaign, without notice at any time, and such cancellation, termination or termination shall be deemed to have taken effect from the date of publication on the Organiser’s website. No liability shall lie against the Organiser in favor of any participant, winner(s) and/ or third party arising from such cancellation, suspension or termination. Therefore, the participant waives his/her right which they may have against the Organiser and hereby acknowledge that they will have no right of recourse or claim of any nature whatsoever against the Organiser.
11.14. This Competition is governed by these Terms and Conditions, as well as those of the relevant authorized participating stores, venues, suppliers ot clients, associated with this Promotion.
11.15. Any dispute or claim arising out of or in connection with the Competition shall be governed by and construed in accordance with the laws of South Africa.
11.16. If part or all of any clause of these Terms and Conditions is illegal, invalid or unenforceable:
11.16.1. It will be read down to the extent necessary to ensure that it is not illegal, invalid or unenforceable, but if that is not possible;
11.16.2. It will be severed from these Terms and Conditions and the remaining provisions of these Terms and Conditions will continue to have full force and effect.
