RAGE FESTIVAL T&C’S

Overview

1.1 By purchasing a ticket or passport to Rage Festival, you agree to be bound by these Terms and all applicable laws and regulations.  Rage Festival is owned and provided by G and G Events and Functions (Pty) Ltd.

1.2 Any references to “we” and “our” are references to “G and G Events and Functions (Pty) Ltd”.

 

2. Age Restriction

2.1 Rage Festival is strictly for persons over the age of 18. Due to liquor license rules and regulations, we will not allow entry to any person under the age of 18 and will take all reasonable endeavours to enforce this rule.

2.2 If you purchase a ticket or passport (hereinafter referred to as a “Ticket”) using false identification or identification that does not belong to you, your Ticket will be revoked and you risk losing any potential refund of the price of the Ticket.

2.3 Having a Ticket does not guarantee you entrance into any Rage Festival venue and valid identification will be requested at all entry points.  Please consult our FAQs for acceptable forms of identification.  Failure to provide proof of identification will result in you being denied access to Rage Festival venues and we will not be liable in any manner whatsoever for refunding you your entrance fee/s.

 

3. Your Ticket (Rage Festival Passport / NFC Bracelet)

3.1 You are solely responsible to hold on to your Ticket and to take all necessary steps to ensure that your Ticket is kept secure at all times during the duration of the festival.  You undertake to immediately inform us if you your Ticket is lost, stolen, damaged or is likely to be used by an unauthorised person.

3.2 All registered, valid, and activated Tickets must be scanned upon entering all official Rage Festival venues.

3.3 G and G and/or official ticket sellers reserve the right to verify your identity upon entering a Rage Festival venue.  If you do not possess a valid form of identification, you will be denied admission into the Rage Festival venue/s, and will not be entitled to a refund of the entrance fee/s. Only original South African ID books/cards, driver’s license cards or state issued passports will be accepted as valid forms of identification.  No certified copies of identity documents will be accepted unless by prior arrangement with G and G.

3.4 We will send you a registration email which will need to be completed in order to finalise your profile registration and Ticket delivery details.

 

3.5 From the 1st of July 2017, we may deliver your Ticket to the stated address provided by you when you completed the initial registration process.  Once the personalisation process has been completed, you will no longer be able to change the address or name, or to exchange and/or upgrade your Ticket.

 

3.6 If your Ticket is lost or stolen, you will not be entitled to a refund of the entrance fee.

 

3.7 All Tickets purchased after the 1st of November 2017 may need to be validated and collected at the ticket office on site at The Sound Factory.

 

3.8 Tickets to Rage Festival may only be purchased by the following means:-

 

3.8.1 from our website, www.ragefestival.co.za;
3.8.2 the Rage Festival App; or
3.8.3 via an official Rage Festival agent’s link.

 

3.9 If you are in possession of a Ticket obtained through any other means, including but not limited to different channels, third party websites or by evading, in any way, the procedure prescribed in the registration link that provides access to the Ticket, you will be denied entry into Rage Festival.

 

3.10 Your Ticket must be personalised or registered between the 1st of July 2017 and the 1st of November 2017.

 

3.11 After the personalisation or registration period, you will not be able to change the name or address linked to the Ticket.  If the name on your Ticket does not correspond with the name on your proof of identification, you will be refused entry into the festival venues.

 

3.12 If your Ticket cannot be delivered to you due to any reason whatsoever, the shipping costs of the Ticket will not be refunded to you.

 

3.13 Selling a Passport

 

3.13.1 Please note that scalping or reselling of Tickets is illegal and not allowed. However, we may allow you to resell your Ticket, provided that your Ticket is sold at the same price you purchased it for and G and G has provided its written consent for you to sell your Ticket.  To obtain written permission from G and G to resell your Ticket, please email passports@ragefestival.co.za and we will notify you how to go about selling your Ticket.  Please note: if you do not obtain our written consent to resell your Ticket, we have the right to invalidate your Ticket without further notice.

 

3.14 Tickets may only be exchanged via our official ticketing provider, NuTickets.  You will be denied admission to the Rage Festival in the event that your Ticket was resold without our prior written consent.  G and G and/or its official ticket seller reserve the right to cancel Tickets if they were purchased illegally or fraudulently via third parties and to institute legal action for any damages we may incur and recover any cancellation costs from you.

 

3.15 We reserve the right to cancel your order in the event that a different number of Tickets are ordered.  In such a case, we will refund you the purchase price, after deducting an administration fee of 10% of the purchase price.

 

3.16 You may cancel your Ticket and request a refund of the purchase price of your Ticket provided that your Ticket has not been delivered or collected. Any refund request thereafter will incur a cancellation charge, dependant on when the refund is requested.  Cancellation may be done at any time prior to the day before the commencement date of the Rage Festival, by sending a cancellation notice to passports@ragefestival.co.za

 

3.17 Once the details of your booking have been reinserted into the system, you will be refunded the face value you paid for your Ticket. You may however be liable for cancellation charges as determined by us, which may be deducted from your refund. The following cancellation charges will apply:-

 

3.17.1. If the cancellation occurs more than 30 days prior to the event, a 25% cancellation fee will apply;
3.17.2. If the cancellation occurs less than 30 but more than 7 days prior to the event, a 50% cancellation fee will apply;
3.17.3. If the cancellation occurs less than 7 days prior to the event, a 75% cancellation fee will apply.

 

3.18 In the event that you provide us with documentary proof that you are unable to attend the Rage Festival due to incapacity or a death in your family, we will not levy a cancellation fee in respect of your Ticket.

 

4. Your Attendance and Behaviour at Rage Festival

 

4.1. If you wish to enter a Rage Festival venue, you must have your personalised or registered Ticket validated upon arrival.  You will be searched by security personnel before being allowed admission into any of the Rage Festival venues.

 

4.2. Inspection at the Rage Festival gates will be in accordance with the applicable laws as prescribed by the Safety at Sports and Recreational Events Act No. 2 of 2010.

 

4.3. Security personnel, of the same sex as you, may request you to be subjected to a thorough pat down and/or search of your clothes and luggage in order to intercept banned objects.  If any banned objects are found in your possession, the security personnel will be entitled to confiscate the object/s and refuse you admission into the festival venues.

 

4.4. Security personnel ALWAYS have the final say, no exceptions.

 

4.5. At Rage Festival venues, you will not be allowed to:-

4.5.1. Enter zones to which your admission ticket does not allow you admission to (comfort zone, press areas, backstage, VIP areas etc);
4.5.2. Climb on tents, constructions, fences, light bridges, benches or any other structures on-site;
4.5.3. Block entrances, exits and/or emergency exits;
4.5.4 Disguise yourself in order to make you unrecognisable with the intention to disturb the peace or put the safety of the other festival goers at risk;
4.5.5. Sell food, drinks or other products without our prior written permission and allocated permits;
4.5.6. Throw or shoot objects in solid, liquid or gas form;
4.5.7. Smoke in non-smoking areas;
4.5.8 Urinate and/or defecate in public;
4.5.9. Wear full facial coverings (masks, morph suits, etc);
4.5.10. Park a vehicle without an official parking sticker issued by us.  In such instances, vehicles may be towed at the owner’s expense;
4.5.11. Tear down, break, damage and/or trash decorations;
4.5.12. Make fires; or
4.5.13. Crowd surf;

 

This list is not exhaustive and if you are found to be behaving in a manner not permissible by us, we reserve the right to expel you or handed over to the police.

 

 

4.6. Wearing texts, symbols, objects, clothes and/or other (visible) external expressions explicitly representing a political, social movement or group is prohibited. Anything hinting at discrimination, hate speech, incitement or racism is strictly prohibited.

 

4.7. Permitted Objects

The following objects are permitted in/at Rage Festival venues:-

 

4.7.1. Guide dogs if you are visually challenged;
4.7.2. Disposable or compact photo cameras;
4.7.3. Telescopic umbrellas without pins (no parasols);
4.7.4. Sun screen, cosmetic products, deodorant in containers up to 100ml;
4.7.5. Refreshers/vaporisers, small back packs and other bags; and
4.7.6.‘Selfie-sticks’, with a maximum length of 1 meter in extended position and solely intended for taking pictures.

 

4.8. Banned Objects

 

The following objects are not permitted to enter Rage Festival venues:-

 

4.8.1. Firearms;
4.8.2. Ammunition;
4.8.3. Knives;
4.8.4. Any sharp or pointed metal object which can reasonably be considered to be a dangerous weapon;
4.8.5. Any dangerous weapon as contemplated in section 1 of the Dangerous Weapons Act No. 63 of 1968;
4.8.6. Explosives;
4.8.7. Tear gas, mace, or similar airborne chemical agent as contemplated in Section 1 of the Tear-Gas Act No. 16 of 1964 or similar airborne chemical or organic agents such as pepper spray;
4.8.8. Narcotics or other mind-altering substances (other than those prescribed by a registered medical practitioner);
4.8.9. Animals (other than guide dogs);
4.8.10. Own food or drinks;
4.8.11. Any glass, plastic or metal food, beverage or condiment receptacle;
4.8.12. Old South African flags;
4.8.13. Banners or flags whose content can reasonably be considered to be vulgar, racist, sexist, discriminatory, inflammatory and/or offensive;
4.8.14. Lasers or similar potentially disruptive light emitting or light reflective/refractive devices or objects;
4.8.15. Any chemical which can reasonably be considered to be hazardous to a person attending Rage Festival;
4.8.16. Fireworks, flares or any similar highly flammable incendiary device or object;
4.8.17. Any device or object which can reasonably be considered to be disruptive to festival goers at Rage Festival;
4.8.18. Projectiles or explosives in solid, liquid or gas form;
4.8.19. Deodorant or perfume in large bottles or containers (over 100ml);
sticks;
4.8.20. walking sticks (medical crutches and devices accepted with medical practitioner’s note); and
Any other object, including but not limited to umbrellas, parasols, camera tripods which the appointed security personnel may decide pose a risk to the other the festival goers.

 

 

 

4.9. Zero Tolerance to Drugs

 

4.9.1. G and G and all venue partners maintain a zero tolerance to drugs of any kind!

 

4.9.2. It is forbidden to carry, use, deal and/or be in possession of drugs at the festival grounds, in any Rage Village Hotel or in any of the festival clubs.  If you are caught contravening or breaching this drugs policy, you will be immediately detained and handed over to the South African Police Service for prosecution.

4.9.3. Admission to the Rage Festival venues is prohibited or may be refused or denied (without entitlement to a refund of the entrance fee) if you, inter alia:-

 

4.9.4.1. Are under the influence of alcohol or any other prohibited substance which has a narcotic effect;
4.9.4.2. Are in possession of or dealing in drugs;
4.9.4.3. Were previously refused admission to other events;
4.9.4.4. Shows behaviour which manifestly hints at an intention to disturb the peace or to provoke, enact violence, hate, rage, etc.;
4.9.4.5. Put the lives or wellbeing of other festival goers at risk;
4.9.4.6. Are in possession of banned objects;
4.9.4.7. Refuse to be searched by security personnel; or
4.9.4.8. Refuse or fail to abide by these Terms.

 

4.10. FAILURE TO COMPLY WITH THE GENERAL RULES, TERMS AND CONDITIONS MAY RESULT IN YOUR ADMISSION BEING REFUSED OR DENIED, OR IN YOU BEING EXPELLED, WITHOUT ANY REFUND OF THE ENTRANCE FEE. IF YOU ARE REFUSED OR DENIED ADMISSION OR ARE EXPELLED, YOU WILL BE OBLIGED TO VACATE THE RAGE FESTIVAL VENUE WITH IMMEDIATE EFFECT.

5. Consent

 

5.1. By purchasing a Ticket, you automatically consent to being photographed, filmed or otherwise recorded and for the resulting images and/or recordings to used or broadcast by G and G and/or its partners.  We may use these images and/or recordings for promotional and/or commercial purposes related to Rage Festival without any compensation being paid to you.

 

5.2. Rage Festival venues are under constant CCTV surveillance in order to maintain and enforce safety at the festival grounds, and to monitor and prevent crimes being committed and/or breaches of these Terms.

 

5.3. You may not use any images and/or recordings made by you at the Rage Festival for commercial or publicity purposes without our prior written consent.

 

6. Safety

 

6.1. To ensure public order and safety during Rage Festival, you are obliged to obey our instructions and directions and/or those of our authorised representatives at the festival venues.

 

6.2. For safety reasons G and G reserves the right to:-

 

6.2.1. interrupt or discontinue Rage Festival at any given time;
6.2.2. prevent you going into festival venues or from leaving festival venues until further notice;
6.2.3. ask you to leave festival venues; or
6.2.4. refuse you admission into festival venues, even if you possess a valid Ticket.

 

7. Sale of Official Merchandise

7.1. All official Rage Festival merchandise will be offered for sale at The Sound Factory or through official Rage Festival Agents.

 

8. Cancellation or Rescheduling

8.1. We reserve the right at any time to cancel or reschedule all or part of Rage Festival, or to alter its programme, due to circumstances beyond our control.  Where we alter its programme, your ticket will remain valid but we shall not be obligated to refund you the price of your ticket or exchange your ticket.

 

8.2. If Rage Festival is rescheduled or cancelled, we will use our reasonable endeavours to notify you as soon as possible by publishing the details thereof on our website and to email and sms you on the contact details you provided at the time of purchasing your ticket.

 

8.3. WE SHALL NOT BE OBLIGATED TO REFUND YOU THE PURCHASE PRICE OF YOUR TICKET IN CIRCUMSTANCES WHERE RAGE FESTIVAL IS CANCELLED DUE TO CIRCUMSTANCES BEYOND OUR CONTROL.

 

9. Disclaimer

 

9.1. By attending the Rage Festival, you expressly agree that such attendance is at your own risk.  We endeavour to provide a service of the highest quality but cannot guarantee the quality of any services provided by independent contractors at the various venues.  There may be occasions when services may be interrupted due to strikes, riots, emergency repairs, technical failures or other reasons beyond our control, including force majeure.

 

9.2. G AND G PROVIDES THE RAGE FESTIVAL AND MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, WITH RESPECT TO THE FESTIVAL OR ITS OPERATION, OR ANY SERVICES OFFERED AT FESTIVAL.

 

9.3. G AND G ACCEPTS NO LIABILITY OR RESPONSIBILITY WHATSOEVER FOR ANY LOSS OR DAMAGE YOU MAY SUFFER BY ANY PERSON AT THE RAGE FESTIVAL.  BY CONTINUING TO ATTEND THE VARIOUS RAGE FESTIVAL EVENTS, YOU ARE DEEMED TO ACCEPT THESE TERMS.

 

10. Limitation of Liability

 

10.1. To the full extent permitted by the laws of the Republic of South Africa, G and G disclaims all warranties and representations, express or implied.

 

10.2. You acknowledge that we do not control the activities of the artist/s who appear at Rage Festival and accordingly we cannot be held responsible for any loss or damage of any kind, resulting from any delay in, overrun or cancellation of an artist’s performance.  We will not be responsible for any special, direct, indirect, incidental, punitive consequential damages, economic or other commercial loss or reputational damage that you may endure by attending the Rage Festival.  Your remedy is limited to leaving the Rage Festival.

 

10.3. G and G will be liable for damages suffered by you if they are directly and solely caused by our gross negligence or fraud.

 

10.4. Excluded from compensation is:-

 

10.4.1. Consequential damages;
10.4.2. Immaterial damages; and
10.4.3. Damage intentionally caused by a festival goer or as a result of his/her wilful negligence.

 

10.5. You will attend Rage Festival at your own risk.  We do not accept any liability whatsoever for damage caused by you entering a venue and/or attending a concert which results in your personal injury, death or damage to your personal property.

 

10.6. G and G shall not be liable for any injury, damage, loss, accident howsoever caused owing from the act, omission, fault or negligence of any suppliers or subcontractors, including but not limited to security personnel, engaged in carrying out contractual arrangements for us at Rage Festival.

 

11. Indemnification

 

11.1. You hereby agree to indemnify and hold harmless G and G and its owners, employees and agents against any costs, claims, suits, proceedings, disputes, losses and damages (including legal fees) incurred by or awarded against G and G as a result of your acts and/or omissions at the Rage Festival, violation of any third party right, violation of any laws and regulations, any misrepresentation made by you or any other person or persons or your breach or alleged breach of these Terms.

 

12. Breach of Terms

 

12.1. If you breach any of these Terms, G and G reserves the right to restrict or deny you access to all or any part of the Rage Festival.

 

13. Amendment to Terms

 

13.1. G and G reserves the right to amend or modify these Terms at any time and at its sole and absolute discretion without prior notice.  Please ensure you review our Terms on a regular basis to ensure you have read the latest version.  Your continued attendance at Rage Festival following changes to these Terms implies that you have consented to those changes.

 

13.2. The Terms were last updated in February 2017.

 

14. Termination of the Rage Festival and Terms

 

14.1. G and G shall be entitled without notice to terminate these Terms at its sole and absolute discretion and reserves the right to modify or discontinue all or any part of the Rage Festival and to restrict or prohibit you access to it at any time, without liability to you or any other person.

 

14.2. Upon termination, all rights granted to you in respect of these Terms will immediately cease.

 

15. Choice of Law

 

15.1 The Laws of the Republic of South Africa shall govern these Terms.

 

15.2 In the event of a dispute of these Terms, any competent division of the High Court of the Republic of South Africa will have jurisdiction.

 

15.3 In the event that any provisions of these Terms is found to be invalid, unlawful or unenforceable by any competent authority, such provision shall be severed and the remaining provisions will continue in full force and effect.

 

16. Complaints and Disputes

 

16.1. All complaints and disputes regarding the Rage Festival may be addressed to info@ragefestival.co.za

 

16.2. Your complaint will be dealt with in a reasonable period of time after receipt thereof and where necessary you may be called upon to provide satisfactory evidence.

 

17. Privacy

 

17.1. G and G respects your privacy and will not disclose your personal information to third parties for marketing purposes if you request us not to do so.  By purchasing a Ticket to the Rage Festival, you consent to the processing of your personal information for promotional and commercial purposes and warrant that all data provided by you is accurate and up to date.  You are responsible for maintaining and promptly updating account information for accuracy and completeness.

 

17.2. If you object to your personal information being used for promotional and commercial purposes, you may submit, at no cost, a written request to us to stop this use.

 

18. General

 

18.1. You may not cede, assign or otherwise transfer your rights and obligations in terms of these Terms to any third party.

 

18.2. No variation, addition, deletion, or agreed cancellation of these Terms will be of any force or effect unless in writing and accepted by or on behalf of the parties hereto.

 

18.3. No indulgence, extension of time, relaxation or latitude which any party (the “grantor”) may show, grant or allow to the other (the “grantee”) shall constitute a waiver by the grantor of any of the grantor’s rights and the grantor shall not thereby be prejudiced or stopped from exercising any of its rights against the grantee which may have arisen in the past or which might arise in the future.

 

18.4. These Terms contain the whole agreement between you and G and G and no other warranty, representation or undertaking is valid, unless contained in this document.

 

18.5. Any failure on you or G and G to enforce any right in terms hereof shall not constitute a waiver of that right.

 

18.6. The headings used in these Terms are included for convenience only and will not limit or otherwise affect these Terms.

RAGE RIDES T&C’s

Rage rides is a transport service offered to rage festival goers.  All rage rides are operated by independent third-party operators and none of the drivers are in the employ of nor do any vehicles belong to the organisers of Rage Festival.

By using the services of Rage Rides, you agree to be bound by the terms and conditions (“terms”) set out below.

Behaviour and safety

  1. Rage Rides are non-smoking vehicles.  If you fail to comply, you will be issued with a spot fine in the amount of R500.00 and will be asked to immediately disembark from the Rage Rides vehicle.
  2. You may not stand whilst being transported in a Rage Rides vehicle.
  3. You may not lie or sit in the aisle of any Rage Rides vehicle.

Banned objects

    1. You are prohibited from carrying firearms or any harmful chemicals, explosives or toxic substances in any Rage Rides vehicle.

Cancellation or rescheduling

  1. Rage Rides will make every reasonable effort to ensure the availability of connections between its services, and to inform you if there are any delays in the connection of its services. Notices via the Rage Festival app.
  2. Rage Rides will endeavour to give you reasonable notice of changes to schedules. Notices via the Rage Festival app.

 Disclaimer

  1. By using Rage Rides, you expressly agree that such use is at your own risk.  Rage Festival cannot guarantee the quality of any services provided by the drivers of the Rage Rides vehicles as they are 3rd parties.
  2. Rage Festival makes no representations or warranties of any kind, expressly or implied, with respect to the quality, suitability, reliability, timeliness or availability of the services offered.

Limitation of liability

  1. Use of Rage Rides is at your own risk, and Rage Festival, its sponsors and organisers will not be held liable under any circumstances whatsoever.
  2. Rage Rides may cancel any of its services upon reasonable notice to you, without any liability.
  3. Rage Festival cannot be held responsible for failure to perform or delays in performance or service delivery due to circumstances beyond its control, such as adverse weather conditions, unpredictable delays caused by traffic congestion, diversions or road works, criminal conduct by third parties, strikes, industrial disputes and regulatory interference.
  4. Rage Festival will not be liable to you for any loss, theft, accident or damage arising from any failure or delay in performance or service delivery due to circumstances beyond its control.
  5. Rage Festival does not have passenger or luggage insurance.  If a Rage Rides vehicle is involved a motor vehicle accident, your remedy is limited to lodging a claim with the road accident fund.
  6. It is your responsibility to ensure that any luggage or personal property is not left in a Rage Rides vehicle after disembarking.

 Indemnification

    1. You agree to indemnify and hold harmless Rage Festival and its owners, employees and agents against any costs, claims, suits, proceedings, disputes, losses and damages (including legal fees) incurred by or awarded against Rage Festival as a result of your acts and/or omissions whilst using the services of Rage Rides, violation of any third party right, violation of any laws and regulations, any misrepresentation made by you or any other person or persons or your breach or alleged breach of these terms.

Breach of terms 

    1. Should you breach any of these terms and conditions, Rage Festival or any Rage Rides driver reserves the right to deny you access to the Rage Rides services.

Amendment of terms

  1. Rage Festival reserves the right to amend or modify these terms at any time and at its sole and absolute discretion without prior notice.  Please ensure you review these terms on a regular basis to ensure you have read the latest version.
  2. These terms were last updated on 1 March 2018.

Choice of law

  1. The laws of the republic of South Africa shall govern these terms.

  1. You are required to (1) have a valid 2018 Rage Festival passport and (2) have it registered in order to qualify for the R50 Rage Festival credit. Please visit https://ragefestival.co.za/passports/ for more information on the Rage Festival passports.
  2. In order to receive the R50 Rage Festival credit, you are required to complete the below process;
    • Successfully register an account on unlocked.me
    • Send a screenshot of the confirmation email received from Unlocked.Me as well as your contact details, via WhatsApp, to 066 190 7304, within 48 hours of receiving the confirmation email.
  3. Failure to complete either one of the above 2 steps will result in you forfeiting the R50 Rage Festival credit.
  4. On receipt of the information as detailed in clause (2.b) above, you will receive a response message from the Rage Festival WhatsApp account within 5 working days, confirming receipt of the valid screenshot and information. Once confirmed, your R50 Rage credit will be loaded onto your Rage Festival cashless profile (credited to the same email address registered to your passport), within 10 working days and will be available for use at Rage Festival, from 30 November – 08 December 2018
  5. Limitations
    • The R50 Rage Festival credit is limited to the first 4000 Unlocked.me signups and is only redeemable once, per passport holder.
    • The R50 Rage Festival credit is exclusively for use at Rage Festival 2018 and can be used at any one of the partner Rage Festival NFC enabled outlets.
    • The R50 Rage Festival credit is non-transferable, nor will you be given the option to cash it out if not utilised. If not utilised, the R50 Rage Festival credit will expire on the 09 December 2018.

  • Please read these Competition terms and conditions (“Terms and Conditions”) carefully. Participation in this Competition constitutes your agreement to comply with these Terms and Conditions. If you do not agree with these Terms and Conditions, please do not participate in this Competition.These Terms and Conditions will govern the Rage Remember Forever With Galaxy 2018 Competition.All participants during the term of this Promotion agree to be bound by the following terms and conditions:

    2. Competition Period

    2.1. The Competition will run from 5 August 2018 (12h00) to 23 October 2018 (00h00) (“the Competition Period”).

    2.2 The duration of the Competition may be extended or curtailed at the discretion of the Organizer.

    2.3 Competition is valid while stock lasts.

     

    3. Who may enter:

    3.1 All participants must :

    3.1.1 be citizens of the Republic of South Africa and/or a legal resident of the aforesaid country,

    3.1.2 be currently residing in the Republic of South Africa at the date of the commencement of the Promotion Period,

    3.1.3 be a natural person and be at least 18(eighteen) years old at the date of the commencement of the Competition Period,

    3.2 Participation in this Competition excludes the Organizer, their directors, members, partners, employees, consultants, any other person who directly or indirectly controls or is controlled by them or any supplier of goods and services in connection with the competition and their spouses, life partners, parents, children, siblings, business partners or associates.

     

    4. How to qualify for the Competition:

    4.1.2 Have registered their passport on Rage Rewards via the 2018 Rage Festival App.

    4.1.3 Participants enter by: Submitting their Remember Forever moment; picture or video via Instagram or Facebook using the #RememberForever #Rage2018 #WithGalaxy.

    4.2 winners will be chosen on the following criteria:

    4.2.1 #RememberForever moments relate to experiences or events that took place from January – October 2018 and more specifically: milestones that took place during your matric / final year.

    4.2.2 Extra merit will be given to those that incorporate features (particularly relating to the main features of the Samsung Galaxy S9) i.e.: Super Slow Mo, Low Light, Water Resistance

     

    5. Should a participant post any material to social media containing nudity, illegal substances or offensive content while associating to the Promoter, Rage Festival or the Sponsor, Samsung Mobile South Africa. The Promoter reserves the right to disqualify that post from the competition.

     

    6. Can I qualify more than once for the Competition:

    6.1 The Competition is limited to one prize per participant. Should there be any dispute in this regard, the Organizer shall be sole adjudicator of the dispute and the Organizer’s decision shall be final.

     

    7. Offer:

    7.1 Weekly prizes

    7.1.1 There are multiple weekly prizes for the best posts of that week. These prizes are Samsung products, either a mobile device or accessory.

    7.1.2 The Samsung device is not transferable for another prize or for cash.

    7.1.3 The Samsung Device redeemed may differ from that shown on the promotional material with regard to colour and specifications and same shall be subject to availability and in the Organizer’s sole discretion to select same.

    7.2 Ultimate Prize

    7.2.1 There is an ultimate prize of a R100 000 upgrade for the winner and their group of friends at Rage Festival 2018 (limited to the winner & 3 friends). This prize is not transferable for another prize or for cash and may not be transferred to another person.

     

    8. The following terms apply when winning a Rage Passport through this competition:

    8.1 If you have already purchased a Rage Passport and the value of that Rage Passport type is less than the value of the Rage Passport that you have won, you will be upgraded to the higher value Rage Passport type.

    8.2 If you have already purchased a Rage Passport and the value of that Rage Passport type is the same value of the Rage Passport that you have won, you have the option to transfer your Rage Passport into another attendees’ name.

    8.3 Please note that if you have already purchased a Rage Passport, refunds will not be applicable.

     

    9. Terms of Delivery:

    9.1 Weekly Prizes:

    9.1.1 G&G will contact the weekly winners via Instagram or Facebook and will request delivery details. Each prize will be delivered within 2 weeks of receiving delivery details.

    9.1.2 Should G&G not be able to get a hold of a winner after 3 attempts, the prize will be forfeited.

    9.2 Ultimate Prize:

    9.2.1 G&G will contact the winner via Instagram or Facebook

    9.2.2 Should G&G not be able to get a hold of a winner after 3 attempts, the prize will be forfeited and another winner will be chosen.

    9.2.3 The ultimate prize excludes accommodation and flights.

    9.2.4 Winners will be informed prior to Rage Festival what to expect from the upgrade.

     

    10. Ultimate Prize Winners Selection

    10.1 A live draw will take place on 31 October 2018 where all weekly winners names will be included and 1 winner will be chosen as the Ultimate #DoWhatYouCant at Rage VVIP Experience winner.

     

    11. Limitation of Liability:

    11.1 To the extent permitted by Consumer Protection Act and any other applicable law:

    11.1.1 The participant and/or winner(s) hereby indemnifies the Organizer against any direct, indirect, special, incidental, consequential or punitive damages or loss of any kind regardless of how this was caused, and whether it arose under the law of contract or delict or otherwise, because of the participants entrance to the Promotion.

    11.1.2 the Organizer excludes all warranties (express or implied), representations and liabilities regarding this Promotion (other than for death or personal injury caused by its negligence and/or fraud).

     

    12. General:

    12.1 In accordance with the confidentiality policies and practices of the Organizer, none of the entry details of any participant in this Promotion will be disclosed or used by the Organizer for any purposes other than for entry into the Promotion and in accordance with clause 9.3 below.

    12.2 Participants acknowledge and accept that the Organizer shall utilise a third party (the “Organizer’s authorized agent/s”) to contact the participant to arrange delivery of the Passport. In order to affect the contacting and delivery process, the Organizer’s shall provide the participant’s information to such third party.

    12.3 Details of participants will not be used by the Organizer for related communication should the participants opt-out to receive further communication from the Organizer.

    12.4 By entering the competition, all participants and winners agree that, G&G Productions may publish the winner(s) name(s) and/or content in any advertising material or digital media for this competition and any other future competitions/promotions.

    12.5 The Organizer’s may in their sole discretion amend these terms and conditions at any time, without notice, and such amendments shall be deemed to have taken effect from the date of publication of the revised terms and conditions on the Organizer’s website

    12.6 The onus rests on the participant to constantly check the website for updates to the terms and conditions.

    12.7 The Organizers reserve the right, at any time, to verify the validity of participants (including a participant’s identity, age and place of residence) and to reject any participant who has not agreed to these Terms and Conditions.     12.8 If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Organizer, including but not limited to technical difficulties, unauthorized intervention or fraud, the Organizer reserve the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the Promotion as appropriate, subject to the approval of relevant regulatory authorities.

  • Rage Rap Competition #BeTheOne 2018Terms & Conditions 2018The terms & conditions have been created and set out by G and G Events and Functions CC (‘the promoter responsible for creation & implementation of the above-mentioned campaign”)
    1. The promoter is: G and G Events and Functions CC t/a G&G Productions, registered company number 2016/049124/07, whose registered office is at 1 Bompas Road, Craighall Park, Johannesburg, South Africa, 2196
    2. Employees of G and G Events and Functions CC t/a G&G Productions or their family members or anyone else connected in any way with the competition or helping to set up the competition shall not be permitted to enter the competition.
    3. There is no entry fee and no purchase necessary to enter this competition.

    5. Entry to the competition will open on 8th October 2018 and closing date for entry will be 00:00 SAST on 26th October 2018. After this date, no further entries to the competition will be permitted.

    7. The rules of the competition and the prize for each winner are as follows:

    7.3 All persons entering the competition, need to be available to attend Rage Festival over the event dates as detailed on the Rage Festival website and in line with the agreed performance dates. The promoter reserves the right to cancel or amend the competition and these terms and conditions without notice in the event of a catastrophe, war, civil or military disturbance, act of God or any actual or anticipated breach of any applicable law or regulation or any other event outside of the promoter’s control. Any changes to the competition will be notified to entrants as soon as possible by the promoter.
    2. The promoter is not responsible for inaccurate prize details supplied to any entrant by any third party connected with this competition.

    1. Voting restrictions: Voting for the competition will commence on 26th October 2018 and closing date for voting will be at 00:00 SAST on 10th November 2018. Voting will be restricted to 1 vote per email address. Should there be any suspicion of fraudulent votes during the competition period, the promoter will investigate the activity and should the investigation prove that the votes for a respective mix were obtained dishonestly or fraudulently in any way, the promoter reserves the right to disqualify the entrant immediately, without any prior notice or warning. Voting is restricted to one user per vote per day.
    2. The 3 finalists will be notified online, by email and/or telephonically on the 11th November 2018. If the winners cannot be contacted or do not confirm their commitment to perform in the finals at Rage Festival within 14 days of notification, we reserve the right to withdraw the prize from the finalist and pick a replacement finalist.
    3. The promoter will notify the 3 finalists when and where the respective prizes can be collected following their selection and announcement at Rage Festival.
    4. The promoter’s decision in respect of all matters to do with the competition will be final and no correspondence will be entered into.
    5. By entering this competition, an entrant is indicating his/her agreement to be bound by these terms and conditions.

    By entering the Contest and creating a Remix You grant to the Partner who made the Eligible Song available for the Contest your full title and interest in Your Remix of that Eligible Song, including but not limited to, copyright and all rights of renewal thereof, for all media, whether now known or hereafter devised, throughout the universe, in all languages, and in perpetuity, all to vest to the Partner immediately after creation of the Remix and all to be exercised by the Partner as it may choose without restriction and without obligation to make any use thereof whatsoever, and You authorize the Partner’s designees and licensees to similarly exercise such rights. For greater certainty, without limiting the generality of the foregoing, you agree to grant these rights regardless of whether Your Entry is chosen as a winner of the Contest

    21.2.2 ASSIGNMENT OF NEIGHBOURING RIGHTS TO REMIX

    By entering the Contest and creating a Remix You irrevocably and unconditionally license, grant and assign to the Partner who made that Eligible Song available for the Contest, in perpetuity, any and all lending, rental and other secondary use or neighbouring rights relating to Your Remix of that Eligible Song, including retransmission rights, which You may now have or will hereafter acquire with respect to the rights granted to the Partner hereunder, without restriction and without obligation to make any use thereof whatsoever, and You authorize the Partner’s designees and licensees to similarly exercise such rights. For greater certainty, without limiting the generality of the foregoing, You agree to grant these rights regardless of whether Your Entry is chosen as a winner of the Contest.

     

    21.2.3 WAIVER OF MORAL RIGHTS IN REMIX

    By entering the Contest and creating a Remix You hereby irrevocably agree to waive any and all moral rights in the Remix You created, and any portions thereof, as such rights may presently or in the future exist, by legislative enactment or otherwise at law or in equity and hereby represent and warrant that You will irrevocably waive Your moral rights therein. You agree not to institute, support, maintain or authorize any action or lawsuit on the grounds that any exercise of the rights granted and assigned to the Partners hereunder constitute any infringement of any moral right in the Remix. For greater certainty, without limiting the generality of the foregoing, you agree to waive these rights regardless of whether your Entry is chosen as a winner of the Contest.

     

    21.2.4 OWNERSHIP OF MATERIALS ADDED TO THE REMIX

    By entering the Contest and creating a Remix you represent and warrant that You own all the intellectual property rights associated with any new materials added to the Eligible Song during the creation of the Remix, or that you are irrevocably authorized to use such intellectual property in connection with the Contest, including that you own or are authorized to use the copyright, all neighbouring rights, and all moral rights therefore, and agree to indemnify and hold G&G PRODUCTIONS and any Partners harmless from any and all costs and expenses (including but not limited to reasonable attorney’s fees), loss, claim, liability or obligations arising out of any breach by You of the representations, warranties and covenants made herein.

    21.2.5 DISSEMINATION OF REMIXES

    By entering the Contest and creating a Remix You agree not to share, transmit, make publicly available or in any way disseminate the Remix to any party other than G&G PRODUCTIONS or the Partners. For greater certainty, without limiting the generality of the foregoing, You agree not to upload Remixes to any website or social media platform, such as Sound Cloud, Band Camp, YouTube, Facebook, or Twitter. Despite the foregoing restriction, G&G PRODUCTIONS may allow You to disseminate Your Remixes on your social networks if Your Remix has high artistic merit and such dissemination is expressly approved by G&G Productions beforehand in writing. We encourage you to contact G&G Productions if you wish to submit your Remix for special consideration to make Your Remix eligible for dissemination through Your social networks.
